Notice to California Residents: This California Consumer Privacy Act ("CCPA") Privacy Notice ("California Notice") applies solely to residents of the State of California and supplements Rain City Capital's General Privacy Policy available at https://www.raincitycapital.com/privacy. This California Notice does not apply to our collection and use of personal information from residents outside of California. Consumers residing in other locations should see our general privacy policy at: https://www.raincitycapital.com/privacy.
1. Overview
Rain City Capital, LLC and its subsidiaries and affiliates (collectively, "Rain City," "we," "us," or "our") are committed to protecting the privacy of California residents. This California Notice is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA"), Cal. Civ. Code § 1798.100 et seq., and describes how we collect, use, and disclose personal information about California consumers, as well as the rights available to California consumers regarding their personal information.
Any terms defined in the CCPA have the same meaning when used in this California Notice. We collect and use information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("personal information"). "Personal information" as used herein does not include: (1) publicly available information from government records; (2) de-identified or aggregated consumer information; or (3) information excluded from the CCPA's scope, such as information subject to the Gramm-Leach-Bliley Act ("GLBA") or the California Financial Information Privacy Act ("FIPA") to the extent such exemptions apply.
2. Personal Information We Collect
In the preceding twelve (12) months, Rain City has collected, and may continue to collect, the following categories of personal information, depending on how you interact with us:

We obtain the categories of personal information listed above from the following sources:
Directly from you, such as when you complete a loan application, register on our website, contact us, or communicate with us by email, mail, text, telephone, or other electronic means;
From brokers and referral partners who refer loan applications to us;
From third-party service providers, including identity verification services, credit bureaus, background list providers, credit reports, and mailing list providers;
Data analytics providers;
Affiliates and joint marketing parties; and
Automatically, as you interact with our website and services (e.g., through cookies, web logs, and similar tracking technologies).
3. Purposes for Collecting Personal Information
We collect and use personal information for the business and commercial purposes described in our General Privacy Policy, including, without limitation:
Creating and managing your account;
Processing and underwriting loan applications, and facilitating and managing financing;
Facilitating lending, servicing, underwriting, marketing, and collections activities;
Providing customer support;
Securitization, loan selling, and enforcement;
Operating, improving, and measuring the performance of our website and services;
Protecting against fraud and other prohibited or illegal activities;
Protecting our rights and responding to legal requests;
Complying with legal obligations, applicable laws, regulations, or court orders;
Providing targeted marketing and advertising;
Managing our information technology infrastructure and security; and
Generating data analytics and research to better understand our customers.
We will not collect additional categories of personal information or use the personal information we collect for materially different, unrelated, or incompatible purposes without providing you with notice.
4. Disclosure of Personal Information
We share your personal information with third parties when it is necessary for a business purpose. When we share personal information to third parties for a business purpose, we require that the recipient not further collect, sell or use such personal information except as necessary for the business purpose.
We may share your personal information with the following categories of third parties: (i) our service providers; (ii) credit reporting agencies and other third parties from which we obtain credit reports and background check information; (iii) our non-affiliated service providers who provide your statements, process your payments, service your loan, or perform other services relating to your account; (iv) our non-affiliated service providers, to the extent necessary to effect, administer or enforce any transaction that is requested or authorized by you; (v) other financial institutions as permitted or required by laws regulating loan securitization; (vi) our affiliates and our joint marketing partners; (vii) our auditors and examiners (either internal or external); (viii) law enforcement, regulators and other government bodies; (ix) third parties as necessary to comply with a law, regulation or a legal process (such as court orders, subpoenas, search warrants or law enforcement requests); (x) our investors and lenders; or (xi) successors in the event of a merger, sale, reorganization, or similar corporate event.

5. “Selling” Personal Information
Rain City does not sell your personal information and has not “sold” personal information (as the term “sell” is defined in the CCPA) in the preceding twelve (12) months.
6. Retention of Personal Information
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to provide you with our services, and to comply with our legal, contractual, and regulatory obligations. Factors considered in determining retention periods include the nature and sensitivity of the information, the purposes for which it was collected, and applicable legal requirements.
7. Your California Privacy Rights
Subject to certain exceptions and limitations, California residents have the following rights under the CCPA:
Right to Know. You have the right to request that we disclose information about our collection, use, disclosure, and sale of your personal information over the past twelve (12) months, including: the categories and specific pieces of personal information we have collected; the categories of sources from which we collected the information; the business or commercial purpose for collecting or disclosing the information; and the categories of third parties with whom we shared the information.
Right to Delete. You have the right to request that we delete personal information we collected from you, subject to certain exceptions (e.g., where retention is necessary to complete a transaction, comply with a legal obligation, or for certain other permitted purposes).
Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you.
Right to Opt-Out of Sale or Sharing. You have the right to direct us to not sell or share your personal information. As noted above, Rain City does not sell your personal information.
Right to Limit Use of Personal Information. You have the right to request that we limit our use of your certain sensitive personal information to those purposes permitted under the CCPA. To make such a request, please use the contact information provided below.
Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, provide a different level or quality of goods or services, or suggest that you may receive a different level or quality of goods or services because you exercised your rights under the CCPA.
8. How to Submit a Request

Verification: We must verify your identity before fulfilling your request. We will ask you to provide information sufficient to verify your identity, which may include confirming information we already have on file. We will not use information provided in connection with a verifiable consumer request for any purpose other than verification.
Authorized Agents: You may designate an authorized agent to submit requests on your behalf. We may require the authorized agent to provide proof of authorization and may require you to verify your identity directly with us.
We will respond to verifiable consumer requests within forty-five (45) days of receipt. If we require additional time (up to an additional forty-five (45) days), we will notify you of the reason and extension period in writing.
9. Financial Information and Regulatory Exemptions
Please note that certain personal information collected by Rain City in connection with lending activities may be subject to other applicable federal and state laws, including the Gramm-Leach-Bliley Act (GLBA) and the California Financial Information Privacy Act (FIPA). To the extent such laws apply, those laws and their associated privacy notices and opt-out rights will govern and may take precedence over the rights described in this California Notice with respect to such information.
Additionally, in accordance with the USA PATRIOT Act, federal law requires Rain City, as a financial institution, to obtain, verify, and record information that identifies each person who submits a loan application to help the government fight the funding of terrorism and money laundering activities.
10. Children’s Personal Information
Rain City’s website is not intended for or targeted towards, and Rain City does not knowingly collect personal information via this website from, children under 18 years of age.
11. Changes to This California Notice
Rain City reserves the right to update or modify this California Notice at any time. When we make changes, we will update the "Last Updated" date at the top of this notice. Your continued use of our website or services following the posting of changes constitutes your acceptance of such changes.
